ELEVATED ENVIRONMENTS TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your use of the Elevated Environments platform and services (“Services”). By creating an account, clicking “I Agree,” or using the Services, you (“Customer” or “Advisor”) accept these Terms.


1. Services Overview

Elevated Environments provides AI-enabled workflow, automation, and support tools for independent college advisors. The Services support administrative tasks, student intake, meeting preparation, summaries, document organization, and productivity workflows.

Elevated does not provide educational consulting or admissions advice. Customer retains full responsibility for its consulting services and client relationships.


2. Account Access

Customer is responsible for:

  • Maintaining the confidentiality of login credentials

  • Ensuring only authorized users access the account

  • All activity occurring under the account

Elevated may suspend or terminate access for misuse or violations of these Terms.


3. Customer Responsibilities

3.1 Lawful Use

Customer will use the Services only for lawful purposes.

3.2 Student & Parent Permissions

Customer is the controller of all student and parent information submitted to the Services (“Customer Data”) and represents that it has obtained all necessary permissions or consent to collect and provide such information to Elevated.

3.3 Data Accuracy

Customer is responsible for the accuracy and completeness of Customer Data.


4. Company Responsibilities

4.1 Service Delivery

Elevated will use commercially reasonable efforts to provide reliable and secure access to the Services.

4.2 Service Provider / Processor Role

With respect to Customer Data, Elevated:

  • Acts solely as a service provider / processor

  • Processes Customer Data only to provide, maintain, and improve the Services

  • Does not sell or share Customer Data

  • Does not use Customer Data for independent commercial purposes

  • Does not combine Customer Data with other data for unrelated purposes


5. Privacy and Security

Elevated uses reasonable administrative, technical, and organizational safeguards to protect Customer Data. Additional details are provided in the Privacy Policy, which is incorporated by reference.


6. Intellectual Property

6.1 Customer Data

Customer retains ownership of all Customer Data.

6.2 Company IP

Elevated retains all rights to the Services, software, AI models, workflows, and related intellectual property. No rights are granted except as expressly stated.


7. Fees and Billing

Subscriptions renew monthly unless canceled. Fees, billing terms, and pricing details are presented at signup. Elevated may update pricing with at least 30 days’ notice.


8. Term and Termination

Customer may cancel at any time. Upon termination:

  • Customer may request export of Customer Data for up to 30 days

  • Thereafter, Customer Data may be deleted during routine cleanup


9. Disclaimers

The Services are provided “AS IS” and “AS AVAILABLE.” Elevated disclaims all warranties to the maximum extent permitted by law, including accuracy of outputs and uninterrupted availability.


10. Limitation of Liability

To the fullest extent permitted by law, Elevated’s total liability in any 12-month period is limited to the fees paid by Customer during that period. Elevated is not liable for indirect, incidental, or consequential damages.


11. Confidentiality

Each party will protect the other party’s confidential information and use it only as permitted under these Terms.


12. Acceptable Use

Customer may not misuse the Services, reverse engineer them, or use them for unlawful or harmful purposes.


13. Governing Law

These Terms are governed by the laws of the State of Delaware.


14. Changes to Terms

Elevated may update these Terms. Continued use of the Services after notice constitutes acceptance.
